Arbitration.

Arbitration is an alternative dispute resolution process to resolve the disputes outside of the courts.  The parties to arbitration usually agree to delegate the decision of the dispute to an impartial arbitrator, either in a contract between the parties ("arbitration clause") or in the middle of litigation. 

In Ontario, the essential legislation regulating arbitration is Arbitration Act, 1991, S.O. 1991, c. 17.  The decision of an arbitrator is usually binding, which means that a party cannot ask a court to reconsider the decision.  The arbitrator`s decision, however, can be enforced before the courts. 

The arbitration process is normally more expedient and cost-efficient comparing to the court process and allows the parties to choose an arbitrator.
