Motion is an appearance before judge when it is
necessary to obtain a court order to address matters before the trial.
Your lawyer schedules a motion date with the court and prepares motion
record to be served to the other parties and to be filed in the court.
A typical motion record contains a Notice of Motion with summary of the
requested order and affidavits in support of the motion.
Motions can be a quick way of bringing a legal action
to the end, but can involve substantial legal costs to prepare motion
record and to appear before a motion court judge. For example, a
motion for summary judgment can be used to promptly dismiss the action
or to obtain the judgment, however the lawyer must have sufficient
evidence to be able to convince the motion court judge that the trial
would be absolutely redundant to determine the litigation.
The courts normally award successful party with
costs, which is compensation for legal expenses pertinent to the motion
the successful party payable by the unsuccessful party.
